The obligations and responsibilities of a surrogate mother

After the surrogate mother voluntarily and consciously decided to carry and give birth to a child for potential parents, she must clearly understand the measure of responsibility for all her actions and commitments.

And this responsibility is not limited to items that are under the supervision of lawyers were agreed and described in the signed contract between the surrogate mother and the potential parents.

We believe that the surrogate mother should take into account not only legal, but also moral and ethical side of the issue: she is responsible for the life and health of the new little human!

The life of a child should not be not marred by illness or suffering because of defects that have arisen through the fault of irresponsible surrogate mother. The kid does not have to suffer because of the fact that the surrogate mother will forget about another examination, just want to "overeat ice cream" or drown in wine a disappointment in her "dull life" or take a walk in the cold rain and get cold …

Sanctions for legal responsibilities that apply to surrogate mothers while those violate their obligations and / or the rights and interests of potential parents and their child are provided not only in the signed the agreement, but can also be found in Criminal, Administrative and Civil Codes of Ukraine. And it can be certain fines, penalties, deductions, and even an imprisonment (for criminal offenses). However, this is only for those who do not understand the measure of responsibility for the child.

Each surrogate mother instructed beforehand about how she should behave while participating in the program. Her commitment seems to be simple, understandable and clearly laid down in the contract and other documents. Here are the basic obligations for surrogate mother:

  • to comply with all the requirements and recommendations of the doctors and the agency supervisor in the first stage of IVF (medication, analysis, the restrictions and abstinence);
  • attend all the appointments and treatments (examinations, tests and procedures);
  • after pregnancy carry, give birth and give the child to the prospective parents;
  • during the pregnancy do not switch the apartments confirmed by the prospective parents and the agency;
  • during the pregnancy unconditionally fulfill all the requirements and recommendations of the doctors (including the regime of the day, nutrition, sexual activity, physical activity, etc.), correctly and on a timely manner take all necessary medications, go through all medical procedures prescribed, and comply with the general rules of hygiene and body care;
  • to register the pregnancy in female consultation;
  • to provide full and truthful information about the health condition and pregnancy on a weekly basis;
  • in case of any changes in the health condition during pregnancy promptly inform the potential parents, the agency supervisor and the doctors who watch this pregnancy;
  • in the case of medical necessity to immediately arrive at certain medical facility for timely access to health care;
  • to terminate the pregnancy for medical reasons (including selective abortion);
  • do not consume alcohol, drugs, uncoordinated drugs or any other substances that are known to be hazardous to the health of a child;
  • to sign an agreement on registering in the body of state registration of civil status acts the prospective parents as biological parents of a child; sign all other necessary legal documents (for foreign citizens);
  • do not pretend for any rights on a child and do not interfere in the transfer of a child to the legal (biological) parents.

Of course, the surrogate mother during the whole period of preparation for participation in the program, as well as during the pregnancy and the initial childbirth will be under constant supervision of doctors and the agency. However, the task of such control is not to limit in some way the pregnant woman, but give her maximum help and support. We tried at the beginning of the new program to create a group of like-minded people who have to perform the most important task - give to the parents a healthy baby!
